The grievor was eligible for enrolment under either the Regular Officer Training Plan (ROTP) or the Community College Entry Plan (CCEP) and his applicant file was therefore sent to both selection boards for consideration. Before the CCEP selection board was held, the grievor was offered and accepted enrolment under ROTP. After his enrolment he was selected by the CCEP selection board, but since he was already enrolled, his file was closed.

Two years later, the grievor heard that some of his colleagues had had their entry plans changed from ROTP to CCEP retroactively, thereby gaining additional benefits, so he requested his be changed as well. After the Canadian Forces Recruiting Group denied his request, the grievor submitted a grievance.

The grievor argued that the recruiting centre did not provide him with adequate information to allow him to make an informed decision when he accepted the ROTP offer. He asserted that had he known more about the differences between the two entry plans, he would have rejected the ROTP offer and waited for the CCEP selection board decision.

The Board determined that, contrary to the grievor's claims, none of his colleagues entry plans had been changed. All of them had been originally enrolled under the CCEP. The Board found it unlikely that the grievor would have been enrolled under CCEP because the sponsors of the program had cancelled enrolments in the program as there were sufficient recruits through the other enrolment programs. In addition, the Board had its doubts that, even with more information, the grievor would have turned down a confirmed offer of enrolment to take a chance on another offer, given the reasons the grievor had provided for accepting the offer.

The Board found that the grievor was properly enrolled under the ROTP and that there were no errors in his enrolment that would justify a change in his enrolment plan.

The Board recommended the grievance be denied.
